By installing, accessing, or using PromptPolly ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

PromptPolly is a browser extension that allows users to generate AI prompts from images through a reverse prompt generation feature. The Service processes images you select to create detailed prompts for use with AI image generation tools.

User Accounts and Registration

You may be required to create an account to access certain features of the Service. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities that occur under your account

User Conduct and Restrictions

You retain ownership of any content you submit to the Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing the Service.

Third-Party Services and Content

The Service may include links to third-party websites, services, or resources that are not owned or controlled by us. We are not responsible for the content, privacy practices, or availability of any third-party services.

When you use AI image generation features, your images may be processed by third-party AI services. We are not responsible for the outputs generated by these services or how they handle your data.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. ANY MATERIAL OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Bajaar LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

Termination

We may terminate or suspend your access to the Service at any time, with or without cause, without notice or liability. Upon termination, your right to use the Service will immediately cease.

You may also terminate your account at any time by contacting us or using the account deletion features available in the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, understandings, or arrangements, whether oral or written.
